Charles McGivney
Managing Partner, Co-Principal
Mr. McGivney is a successful, experienced civil trial attorney. He has represented a wide array of clients on the trial and appellate levels of both State and Federal courts in a number of jurisdictions. Specializing in the defense of toxic tort, product liability, and environmental matters, Mr. McGivney has successfully served as trial counsel in asbestos, mold spore, and professional liability claims for architects, lead, repetitive stress, sick building syndrome, silica, and chemical exposure litigation, as well as on complex products liability, life insurance coverage, fire loss, subrogation, and negligence matters. A prolific author, Mr. McGivney has written many treatises on the above areas of practice and lectured extensively before the insurance industry on the methods of evaluating and defending cases in the toxic tort arena.
In 1994, Mr. McGivney founded McGivney & Kluger, P.C., an insurance defense firm that specializes in the areas noted above. The firm boasts more than 12 offices nationwide, including New York, New York; Florham Park, New Jersey; Philadelphia, Pennsylvania; Syracuse, New York; and Farmington, Connecticut.
Our founding partner does considerable work for the insurance industry. He is actively in charge of the defense of multiple asbestos clients in New York City and Upstate New York and has been appointed "Joint Medical Counsel" for New York asbestos litigation by many insurance carriers. Currently, Mr. McGivney has restricted his time to handling particularly dangerous, high-profile claims in the toxic tort arena, including chemical and mold exposure claims in New York and New Jersey. He is also coordinating the defense of personal injury claims throughout the country on behalf of a number of insurance carriers where it is alleged that exposure to mold has caused permanent neurological injury. In addition, Mr. McGivney has handled insurance coverage matters providing counsel and coverage opinions to a number of our carriers. Mr. McGivney received his undergraduate degree from Fordham University and graduated from Villanova University School of Law.
He is a member of the Product Liability and Toxic Tort Committees of the New Jersey State Bar Association and the New Jersey Defense Association. Mr. McGivney is admitted to practice in New Jersey, New York, and Pennsylvania and is admitted before the United States District Court of New Jersey; the United States District Court of Pennsylvania for the Eastern District, and the United States Court of Appeals, Third Circuit. Mr. McGivney has successfully tried asbestos, lead, and toxic tort matters as well as negligence, premises liability, and automobile accident cases in the States of New Jersey, New York, and Pennsylvania. Mr. McGivney has lectured for the American Conference Institute at seminars in New York, San Francisco, Chicago, and London regarding "Developments in Medical Criteria for Asbestos Cases."
