On February 1, 2021, attorneys Lawrence McGivney and Jonathan Lee obtained a judgment from the Superior Court of New Jersey, Union County, on behalf of the firm’s client, a roofing contractor. The roofer had pursued a former client for outstanding bills, and was counter-sued for more than a million dollars, alleging that the work performed was negligent, allowed water infiltration, and ultimately cost the former client significant rental income from lost tenants. Through discovery, it was revealed that certain of these claims were without basis. After several discovery motions, MKCI was able to preclude significant evidence in support of the claimant’s damages, and thereafter obtained and won enforcement of an arbitration award, which dismissed all of the damages claims and allowed MKCI’s client to pursue an attorney fee award.
