Environmental Litigation
The Environmental Practice Group is comprised of attorneys and support staff with broad based experience in environmental contamination litigation. The firm has defended a wide variety of complex environmental civil litigation and governmental enforcement matters seeking site remediation, contribution and cost recovery for hazardous waste, air, water and soil pollution and contamination. We have extensive experience in Superfund response and allocation as well as defending claims made by private parties and State and Federal regulators.
Prior representations include state and federal actions, federal CERCLA and New Jersey Spill Compensation and Control Act litigation, and responses to USEPA Letters of Notice of Potential Liability and Requests to Perform RI/FS pursuant to 107(a) CERCLA, 42 USC sec. 9607. Our firm has also defended claims and advised clients under the New York Navigation Law and the New York Environmental Conservation Law as well as the State Environmental Quality Review Act (SEQRA) and the Resource Conservation and Recovery Act (RCRA).
Our experience includes the defense of a broad variety of corporate clients in litigation and governmental actions for cost recovery and contribution, remediation, nuisance, trespass, property damage, and natural resource damage involving allegations of contaminated groundwater, discharge of solid and hazardous materials and waste, exposure to toxic fumes and substances and leaking underground storage tanks.
