Neil S. Bromberg

Neil S. Bromberg is a Partner in MKCI’s New York City, NY office. His practice focuses on the overall defense of serial, mass tort, and other complex litigation matters, with a particular emphasis on defending—and trying—pharmaceutical, talc, asbestos, and other products liability litigation.
Spanning a 30-year career, Neil has gained a profound understanding of the legal challenges surrounding complex liability cases and developed an ability to ramp up to speed quickly on sophisticated scientific and medical issues surrounding each case. Subscribing to a “no surprise” philosophy when practicing law and representing clients, Neil works hard to develop close relationships with his clients believing the better the relationship, the better he can work on their behalf. As national counsel for a cosmetic talc manufacturer in asbestos litigation, Neil conducted internal investigations, advised senior management, defended all corporate depositions, and developed legal strategy that limited company exposure and successfully kept the company from going to trial.
Neil also led and managed the defense of over 150 cases in New Jersey mass tort litigation involving a pharmaceutical company’s cancer therapy, resulting in dozens of summary judgment wins, voluntary dismissals and ultimately favorable resolution of all cases. As trial counsel, he secured defense verdicts for Novartis Pharmaceuticals Corporation in the first and second bellwether cases chosen for trial in New Jersey litigation over the drugs Aredia® and Zometa®. Meng v. Novartis Pharm. Corp. (N.J. Super. Ct. Law Div.); Bessemer v. Novartis Pharm. Corp. (N.J. Super. Ct. Law Div.).
Most recently, Neil oversaw and prepared for trial various expert teams leading to defense verdicts on behalf of a pesticide company in litigation alleging that the product Roundup caused cancer. Known to be a powerhouse when questioning witnesses, Neil’s significant experience defending and deposing expert witnesses in various fields, including oncology, oral surgery, neurology, obstetrics, pharmacology, and internal medicine, extends beyond the deposition stage. He specializes in zealously designing and implementing strategies to exclude (or limit) expert testimony through motions practice or evidentiary hearings pursuant to Daubert, Kemp, and similar admissibility standards.
With extensive toxic tort experience, having previously represented gasoline manufacturers in personal injury and wrongful death litigation involving alleged exposure to benzene, Neil has served as past co-chair of the Mealey’s Benzene Litigation Conference. He has spoken frequently on talc litigation, including at a cosmetic industry conference, and participated on panel discussions related to Daubert, in addition to giving numerous presentations on a variety of issues including e-discovery and scientific evidence. Neil also ran as a nominee to represent the D.C. Bar in the American Bar Association House of Delegates and previously served on the Continuing Legal Education Committee of the Washington D.C. Bar’s Board of Governors and on the Steering Committee of the D.C. Bar’s Litigation Section. Neil has also served as an appellate judge for the American Bar Association’s National Appellate Advocacy Competition.
Outside his work with MKCI, Neil has travelled around the world to go skiing, white water rafting and zip lining. He also has a passion for live music and attends more than 50 concerts a year.
Neil graduated cum laude and Order of the Coif from the University of Pennsylvania the Law School, where he was an Editor for the University of Pennsylvania Law Review. He obtained a Bachelor of Arts degree in Political Science from Brandeis University.
