On February 8, 2024, MKCI Of Counsel and trial counsel Amelia Dweck obtained a unanimous defense verdict in a transportation matter in the Supreme Court of Kings County, New York.
Amelia represented a yellow cab driver that was allegedly involved in a sideswipe collision with a Fed Ex driver, with conflicting claims of how the collision occurred, and whether the defendant driver was changing lanes at the moment of impact. Plaintiff claimed serious damages including a L4-5 discectomy surgery and fusion.
In addition to orthopedic and radiology experts, Amelia utilized Dr. Robert Fijan’s biomechanical report that showed that the plaintiff’s claimed injuries could not have happened anatomically under the circumstances of the collision.
Amelia flew our driver in from Chicago, prepped him the day before he testified, and got a unanimous 6-0 decision from the jury on Question #1 – was our driver negligent?
